Terms of Use

The version of the ToU currently posted on the website is the only one that applies and is legally binding on Users until replaced by a new version. The Government reserves the right to amend these ToU at any time. These ToU will take effect on the date of their publication on the Website.

You are therefore advised to refer regularly to the most recent version of the ToU posted permanently on the Website.

Forbearance in enforcing the provisions of these ToU may under no circumstances be considered as the Government relinquishing its right to avail itself of them at a later date.

In the event that any of the provisions in these Terms of Use is or becomes invalid in light of a current or future provision of the law, such provisions shall be deemed unwritten without affecting the validity of the other stipulations herein.

 

1. DEFINITIONS

For the purposes of these Terms of Use, words and phrases below which begin with an upper case letter, either singular or plural, have the following meanings:

 

  • Government”: the Prince’s Government of Monaco / Digital Services Department.
  • Terms of Use” or “ToU”: these Terms of Use.
  • Personal Data” / “Personal Information”: any information relating to an identified or identifiable individual (“data subject”). An “identifiable individual” is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.
  • Services”: the services provided via the Website and which enable any User to access:

2. PURPOSE

These Terms of Use set out the terms and conditions for using and browsing the VisitMonaco Website. The Website provides tourist information and promotes the Destination, including by providing a trip planner, an interactive map, articles and an events calendar.

 

3. ACCESS TO THE WEBSITE

In order to access and browse the VisitMonaco Website, you must have a sufficiently fast internet configuration and hardware. You access the Website at your own discretion and at your own cost.

The Services may be accessed freely and securely via the URL https://visitmonaco.com.

In the event that the Services are suspended or unavailable, you may contact the Government for information.

 

4. UNDERTAKING ON THE USE OF THE WEBSITE AND ITS CONTENT

Acts detrimental to the name and/or image of the State of Monaco, or which may damage, overload, discredit or cause the failure of the Website, are strictly prohibited by these Terms of Use.

Such acts include, but are not limited to: transmission via the Website by email or otherwise, and association with the Website, of content intended to persecute, harass, bully, defame, discriminate, or insult, or the transmission of any other information or opinions of a personal nature concerning one or more individuals or which infringe human rights or harm minor Users.

All correspondence with the Monaco Government Tourist and Convention Authority via the contact form provided must be courteous and observe the basic rules of civility.

 

5. WEBSITE SECURITY

You must not fraudulently access or remain in any part of the Site, delete or modify any content, introduce data unlawfully, alter the Website, or disrupt its proper operation.

In particular, you must not: (i) reproduce, modify, adapt or alter the Website and/or its content; (ii) use the Website for any unlawful purpose. This includes not providing any false, incomplete or inaccurate information, and not introducing any virus, Trojan horse, worm, time bomb or any other programme designed to damage, adversely affect, intercept or counter any system, data or personal information.

 

6. INTELLECTUAL PROPERTY

These Terms of Use do not grant you any rights of intellectual property of any kind.

1. Copyright

All rights attached to any content published on this Website are the exclusive property of the Government, unless specifically attributed to a third party. This includes, but is not limited to, all texts, comments, titles, names, photographs, sounds, images, data, drawings, animated sequences with sound, videos, functionalities and charts, which are protected by copyright law applicable in the Principality of Monaco.

The use, representation, transformation, reproduction, adaptation or distribution of any part or content of the Website whatsoever, whether wholly or partially, on any media and by any means whatsoever, are prohibited without the express permission of the Government, and constitute a criminal offence which may be prosecuted by the courts of Monaco.

2. Trademarks

Trademarks and/or logos owned by the Government and appearing on this Website are protected by statutory provisions applicable in Monaco. Any reproduction of these trademarks and/or logos, in whole or in part, without the permission of the owner, is a criminal offence and will be prosecuted by the Monaco courts.

 

7. LIABILITY

The Services must not be used in an abusive or malicious way. You are aware of the risks involved in using the internet, such as hijacking, and you accept the limitations and risks thereof.

Generally, you undertake to use the Services:

  • in accordance with Monegasque laws and regulations, the rights of third parties, and intellectual property rights;
  • fairly and in accordance with their intended purpose;
  • at your own risk.

The Government cannot be held liable in the event that the Website does not operate correctly, a malfunction occurs, or internet access is restricted or degraded.

The Government makes no express or implied warranties regarding the operation of this Website and cannot be held liable for any direct or indirect, commercial or other damage, or any consequences resulting from incorrect or outdated information published on it.

 

8. PERSONAL DATA PROTECTION

In accordance with personal data protection provisions applicable in the Principality of Monaco, information collected via the VisitMonaco Website is processed by the Government of the Principality of Monaco (Ministry of State, Place de la Visitation, 98000 Monaco) and used by the Tourist and Convention Authority, referred to herein simply as the “Government.”

The Tourist and Convention Authority processes personal data for the purpose of “Operating the VisitMonaco Website”, and specifically in order to:

  • allow browsing (cookies);
  • allow individuals to contact the Government and certain identified partners via a contact form;
  • allow Users to watch videos (YouTube cookies);
  • publish tourist information (blogs, articles, etc.) ;
  • suggest customised itineraries for persons visiting the Principality;
  • generate anonymous statistics.

The legal basis for this processing is:

  • the consent of the data subject (specifically for cookies and the online contact form);
  • the pursuit of legitimate interests by the Government: to enable the Tourist and Convention Authority to promote Monaco as a destination and publish tourist information.

Information processed via the Website may be accessed by:

 

  • authorised personnel of the Tourist and Convention Authority:
  • authorised personnel of the Digital Services Department and those it has mandated to support the Tourist and Convention Authority with the website launch process;
  • the Information Technologies Department and personnel it has mandated to carry out information systems management, maintenance, and hosting on Government servers;
  • authorised personnel of any service provider mandated to carry out systems integration or website maintenance tasks.

Information relating to the itinerary is stored locally for one year after your last visit, as follows:
- When you visit the website, the LastVisitDate value is checked against the current date.

You must provide a black and white copy of your identity document.

The copy of the identity document will be destroyed once the request is processed.

Data subjects may make a complaint to the Personal Data Protection Authority if they believe the Government has failed to meet its obligations with regard to the exercising of these rights.

 

9. PROCESSING OF PERSONAL DATA COLLECTED FOR THE PROMOTION OF MONACO AS A TOURIST DESTINATION (VIA THE CRM)

The Government of the Principality of Monaco (Ministry of State, Place de la Visitation, 98000 Monaco) processes personal data for the purpose of promoting Monaco as a tourist destination via a Customer Relationship Management (CRM) system operated by the Tourist and Convention Authority.

The CRM is used to support organisations planning large-scale events in the Principality, such as conferences and seminars, which require extensive advance preparation. The Tourist and Convention Authority acts as a liaison between event organisers and local service providers in the Principality (hotels, restaurants, congress centres, places of interest, leisure and relaxation venues, excursion operators).

As such, it processes personal data as part of its official remit as stipulated by Sovereign Ordinance No. 4,809 of 9 November 1971 creating the Tourist and Convention Authority and Sovereign Ordinance No. 3,880 of 12 October 1967. The legal basis for this processing is the public interest.

The personal data collected is professional in nature and includes only information needed to contact an individual responsible for organising an event, and information about the event itself.

The State of Monaco should be clearly mentioned in the link. The Government reserves the right to request removal of all existing links which contravene the Website’s purpose.

The VisitMonaco Website may contain hypertext links to third-party websites. The Government does not control these websites and may under no circumstances be held liable in any way for their content.

The Government may not be held liable for any damage or loss that may result from or be connected with the use of these external websites. Users of this Website use such third-party websites at their own liability and risks. The Government accepts no liability whatsoever.

11. APPLICABLE LAW - JURISDICTION

The courts of Monaco shall have sole jurisdiction to adjudicate any disputes arising as to the interpretation or performance of these ToU in the event that an amicable resolution cannot be reached, and solely the laws of Monaco shall apply.
